Terms of Service

By accessing or using SiteKD (the "Service"), you confirm that you are at least 18 years old, have authority to bind your business (if applicable), and accept these Terms and our Privacy Policy.

If you do not agree, you must not use the Service.

SiteKD provides website design, development, build, and maintenance services for clients worldwide, delivered from our London studio. Each project begins with individual analysis and is agreed through a tailored proposal — no standard packages or fixed plans.

We may change, suspend, or discontinue certain aspects of the Service with reasonable notice where possible. We strive for reliable operation but do not guarantee uninterrupted availability.

You must provide accurate information and keep your access credentials secure. You are responsible for all activity under your account or project.

We may suspend or terminate access for breach of these Terms, security risk, or unlawful or abusive behaviour.

If you provide a mobile number, you agree to receive transactional SMS related to the Service (such as confirmations, security, and billing). Marketing SMS requires separate consent as described in our Privacy Policy.

Each proposal is prepared individually after analysing your needs. Price, scope, timelines, and maintenance terms are confirmed in writing in the proposal or contract before work begins.

Payments are made according to the proposal terms — typically a deposit before work starts and the balance on acceptance, unless otherwise agreed. Currency and payment method are stated in the proposal.

You authorise us and our payment processors to charge your chosen payment method for all applicable fees and taxes.

Non-payment may result in work being paused or maintenance being terminated without refund of amounts already paid.

Fees paid to SITEKD LTD are generally non-refundable after work on the project has begun, except where applicable law requires otherwise. Without limiting the above:

• Deposit payments for work already started are not refunded if you terminate without our agreement
• One-off design, development, or migration fees are not refunded after stage acceptance
• Maintenance fees are not refunded for unused periods
• Payment disputes without prior contact with hello@sitekd.com may result in immediate suspension of service

At our discretion we may offer an adjustment or credit in rare cases (e.g. a proven duplicate invoice). Any such gesture is goodwill and does not create an obligation for future refunds.

Nothing in these Terms excludes liability that cannot be excluded under mandatory consumer law.

You may terminate a maintenance agreement by sending written notice by email to hello@sitekd.com. Termination by you requires 30 (thirty) calendar days notice before the desired end date. Notice must come from the email address stated in the proposal or contract and include a clear date on which you want the service to end.

Termination stops future billing after the notice period expires but does not refund past payments. Access to maintenance typically continues until the end of the notice period or the current paid period — whichever is later — unless otherwise stated in the proposal.

After service ends, the price and terms from your original proposal are not preserved. If you resume maintenance or another SiteKD service, you receive a new individual proposal at our current terms and prices — with no guarantee of the same value, discount, or promotional conditions.

We may send you SMS, email, and other messages regarding your project, proposal, and the Service. You agree to use these channels in compliance with applicable law.

Your obligations: If you use messaging features towards your clients, you are responsible for obtaining and documenting valid consent and honouring opt-out requests, including replies of STOP.

Our messages to you: By using the Service and providing a phone number, you authorise SITEKD LTD to send transactional SMS. Marketing SMS requires separate consent. See our Privacy Policy for opt-out instructions.

You agree not to:

• Violate applicable law or third-party rights
• Send spam, unlawful content, or malware
• Attempt unauthorised access to systems or accounts
• Reverse engineer, scrape, or resell without permission
• Use the Service for fraudulent, misleading, or harmful purposes

You retain ownership of content you provide. You grant us a limited licence to host, process, and display it solely to provide the Service.

You are responsible for compliance of your clients' data. On termination we may delete data after a reasonable retention period as described in the Privacy Policy.

SiteKD, our branding, software, and documentation are owned by SITEKD LTD or our licensors. These Terms grant you no rights except limited use of the Service as provided.

After full payment, rights in the delivered website transfer according to the individual proposal terms, unless otherwise agreed.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

We do not warrant that the Service will be error-free, uninterrupted, or meet every business expectation.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SITEKD LTD AND ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR REPUTATION.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

You agree to indemnify and hold harmless SITEKD LTD from claims, damages, and expenses arising from your use of the Service, your content, or breach of these Terms or applicable law.

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles, except where mandatory local law requires otherwise.

Disputes fall within the exclusive jurisdiction of the courts of England and Wales, except where consumer law gives you non-waivable rights to bring proceedings in your country of residence.

We may update these Terms at any time. Updated Terms will be posted on this page. Material changes may be notified by email. Continued use after they take effect constitutes acceptance.
